Terms of Service

These Terms of Service ("Terms") govern your use of services provided by CloudBeem (a brand of POISE), including domain registration, web hosting, and related services. By using our services, you agree to these Terms.
1. Definitions
- "CloudBeem", "we", "us": Refers to POISE, the operator of CloudBeem services.
- "Customer", "you": Any individual or entity using our services.
- "Services": Domain registration, web hosting, email hosting, Microsoft 365 licensing, and any related services.
2. Service Agreement
By placing an order through our website or client portal, you enter into a service agreement with us. The agreement begins when we confirm your order and lasts for the initial service period selected.
3. Domain Registration
- Domain registrations are subject to the terms and conditions of the respective domain registry and ICANN policies.
- We act as an intermediary between you and the domain registry. Domain ownership is subject to registry rules.
- You are responsible for ensuring that your domain registration does not infringe on any third-party rights.
- Domain renewals must be processed before the expiration date. We are not responsible for domains that expire due to non-payment.
4. Web Hosting
- Hosting resources (disk space, bandwidth, etc.) are as specified in your selected plan.
- You are responsible for the content hosted on your account. You must not host illegal content, malware, phishing sites, or content that violates Swedish or EU law.
- We reserve the right to suspend accounts that violate these terms or negatively impact server performance.
- We perform daily backups as a courtesy. However, you are responsible for maintaining your own backups of critical data.
5. Acceptable Use
You agree not to use our services for:
- Any illegal activity under Swedish or EU law.
- Distributing malware, viruses, or malicious software.
- Sending unsolicited bulk email (spam).
- Hosting phishing pages or fraud-related content.
- Cryptocurrency mining or other resource-abusive activities.
- Distributing copyrighted material without authorisation.
6. Payment and Billing
- Invoices are issued according to the billing cycle of your service (monthly, annually, etc.).
- Payment is due within the period specified on the invoice.
- Failure to pay may result in service suspension after reasonable notice.
- Prices may be adjusted with at least 30 days notice before the next billing period.
7. Refund Policy
- Domain registrations are non-refundable once processed with the registry.
- Hosting services may be eligible for a refund within 14 days of initial purchase, in accordance with EU consumer rights.
- Refund requests should be submitted through the client portal or by email.
8. Service Level
We aim to provide 99.9% uptime for hosting services. Scheduled maintenance windows are excluded from uptime calculations. We will provide reasonable notice for planned maintenance.
9. Limitation of Liability
To the maximum extent permitted by Swedish law:
- Our total liability is limited to the fees paid for the service in question during the 12 months preceding the claim.
- We are not liable for indirect, consequential, or incidental damages, including lost profits or data loss.
- We are not responsible for service interruptions caused by factors outside our control (force majeure).
10. Termination
- You may cancel your services at any time through the client portal.
- We may terminate services with 30 days notice, or immediately in case of terms violation.
- Upon termination, you are responsible for migrating your data. We will retain data for 30 days after service termination.
11. Governing Law
These Terms are governed by the laws of Sweden. Any disputes shall be resolved by the Swedish courts. For EU consumers, mandatory consumer protection laws of your country of residence also apply.
12. Changes to Terms
We reserve the right to modify these Terms. Material changes will be communicated via email or the client portal at least 30 days before taking effect.
